Welcome to ARC Online Training! By accessing Airline Reporting Corporation’s (“ARC”) platform and using our training services (the “Services”), you understand and agree to be bound by the following terms and conditions (“Terms of Use” or “Terms”). Please read them carefully before using our Services.
Acceptance of Terms. By registering for and/or using the Services in any manner, including visiting or browsing the site, you agree to these Terms of Use and all other operating rules, policies, and procedures that may be published from time to time on the site by ARC, each of which is incorporated by reference and each of which may be updated from time to time without notice to you.
Eligibility. You must be at least 18 years of age to use this Service. By agreeing to these Terms, you represent and warrant to us that: (a) you are at least 18 years of age; (b) you have not previously been suspended or removed from the Service; and (c) your registration and your use of the Service is in compliance with any and all applicable laws and regulations.
Account Registration. To access most features of the platform, you must register for an account. When registering, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure and in compliance with ARC’s requirements as communicated to you. You agree that you will not give out login and/or password information to other users or any external parties. ARC reserves the right to cancel any registration if we discover that a student account is being used by more than one person, or if a login/password is given to another person, regardless of whether they actually use it.
Course Enrollment and Access. Upon enrollment in a course, you are granted a license to view the course via the ARC Online Training platform, and ARC is the licensor of record. Courses are licensed, and not sold, to you. This license does not give you any right to resell the course in any manner (including, but not limited to, by sharing account information with a purchaser or illegally downloading course content and sharing it with others).
Payments, Credits, and Refunds. Fees for courses and other Services are stated on the platform. You agree to pay the fees for courses that you purchase, and you authorize us to charge your debit or credit card or process other means of payment for those fees. ARC Online Training works with third party payment processing partners to offer you the most convenient payment methods in your country and to keep your payment information secure. To the maximum extent permitted by applicable law, the liability disclaimer stated below in Section 11 shall apply to any willful misconduct, illegal acts, fraud, misrepresentation, or gross negligence by any entity that may be engaged by ARC or ARC’s authorized service provider to facilitate ARC’s provision of the Services.
System Availability. ARC will make every effort to ensure that ARC Online Training remains operational 24 hours a day. However, there may be times when the servers are down due to power outages, network problems, or regular maintenance. You acknowledge and agree that this is reasonable, and that ARC shall not be liable under any such circumstances.
User Conduct. You are prohibited from using our Service for any unlawful purpose, or to solicit others to perform or participate in any unlawful acts. You may not access or use the Service to conduct any market research, including, but not limited to, for the purpose of a establishing a business that provides products or services that may be considered competitive to those of ARC.
Intellectual Property. All content provided on the platform, including all courses, text, graphics, logos, images, as well as the compilation thereof, and any software used on the site, is the property of ARC and/or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. By participating, you agree to not distribute any copyrighted material for any purpose. This includes, but is not limited to instructional material, questions, and rationale. The sharing of user login information, to share course material or for any purpose is strictly prohibited.
Termination. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.
Changes to Terms. ARC reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Liability Release. You understand and agree that ARC Online Training presents information from instructors whom it believes to be experts in the subject matter. ARC and its employees are not experts in the matters presented. Specifically with respect to employee Guides to Health, ARC and its staff are not health care providers. ARC and its staff are not responsible for any inaccuracies in course data and are not liable for any damages that may result.
YOU AGREE THAT YOU ASSUME ALL RISKS ARISING FROM TAKING THIS COURSE, EVEN IF ARISING FROM THE NEGLIGENCE OF OTHERS, INCLUDING ARC AND ITS OWNERS AND STAFF. THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARC, ITS OWNERS, AND ITS STAFF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR CONTENT.
Without limiting the foregoing, you agree that ARC Online Training is not responsible for your inability to login to the courses, either because of poor Internet connections, incorrect typing of logins and passwords, and/or browser incompatibility.
Privacy. ARC Online Training takes privacy matters very seriously. Depending on what you do when you visit any website, you are providing information about your visit to the site's owners. This includes ARC Online Training. We value privacy and think you do too, so we want you to have the information you need to make your own decisions about your personal privacy.
We at ARC Online Training use the information that we get from your visits for internal tracking purposes, to make the ARC Online Training as useful and interesting to you as we can, and to respond to your requests for information or other services. Except as specifically noted herein, we do not use your personal information for any other purpose, and we never sell it to any third party.
ARC Online Training also uses standard Web server log files, to help us count visitors and evaluate our site's technical capacity. We use this information to find out how many people visit ARC Online Training, help us arrange the pages of the courses in the most user-friendly way, keep the site browser-friendly, and to make our pages more useful to our students. We may record information on site traffic generally but not on individual users’ behavior.
